These Terms of Service ("Terms") govern your access to and use of SendDeck ("Service"), operated by SendDeck ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must create an account to use most features of SendDeck. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current information during registration and keep it updated. You must be at least 18 years old to create an account.

Your content: You retain full ownership of all content you upload to or create through SendDeck. By uploading content, you grant us a limited license to host, store, and serve your content to the viewers you authorize — and only to those viewers.
AI-generated content: Content generated using our AI features is owned by you, the account holder. We do not claim ownership of AI-generated documents. However, you are responsible for reviewing and ensuring the accuracy and appropriateness of all AI-generated content before sharing it.
Our content: The SendDeck platform, interface, branding, and documentation are our intellectual property and may not be copied, modified, or distributed without permission.
All uploaded and generated content is scanned for security threats including malicious scripts, phishing elements, and harmful code. We reserve the right to reject, remove, or quarantine content that fails safety checks or violates these Terms, with or without notice. Repeated violations may result in account suspension or termination.
Paid plans are billed monthly or annually via Stripe. Prices are in USD and exclusive of taxes unless stated otherwise. Upgrades take effect immediately; downgrades take effect at the end of the current billing period. We may change pricing with 30 days' notice to existing subscribers. Refunds are handled on a case-by-case basis — contact support@senddeck.ai.
AI credits: Each plan includes a monthly allocation of AI generation credits. Unused credits do not roll over. Credit costs vary by generation mode (Standard or Enhanced). Overage credits may be purchased at the rates listed on our pricing page.
Enterprise plans require you to bring your own API key ("BYOK") for AI generation features. You are solely responsible for your API key security, usage, and any charges from the API provider (e.g., Anthropic). We do not have access to your API key beyond the minimum necessary to execute generation requests on your behalf. API keys are stored encrypted and are only accessed server-side during generation.
We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications to the Service at any time. We will provide reasonable notice for planned downtime when possible. We are not liable for any losses resulting from service interruptions.
Your use of SendDeck is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
To the maximum extent permitted by law, SendDeck and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless SendDeck from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.
SendDeck offers optional SMS notifications for platform administrators. By opting in to SMS notifications, you consent to receive up to 30 text messages per month from SendDeck regarding system events, including new user signups, document activity, and system alerts. Message and data rates may apply.
SMS consent is not required to use the Service and is not a condition of any purchase. You may opt out at any time by replying STOP to any message. Reply HELP for assistance, or contact support@senddeck.ai. Our SMS service provider is Twilio. See our Privacy Policy for details on how your phone number is stored and used.
You may close your account at any time from your Settings page. We may suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, your documents will remain accessible for 30 days to allow data export, after which they will be permanently deleted.
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
